Why Are Tanker Truck Accidents Complex?

tanker truck may also be referred to as a gas truck or fuel truck. It is a motor vehicle designed to transport liquids or gases on the roadway. Because of their massive size and ever-changing center of gravity, they are highly susceptible to a rollover accident as the liquid moves around inside.

An accident with a tanker truck is likely to be a devasting event. Aside from the impact of the commercial vehicle, there is potential damage from the cargo they are transporting inside their truck. The impact is likely to be widespread due to the potential leak of the liquid or gas beyond the actual collision.

The human and environmental results of an accident of this type are likely to impact more than just the occupants of vehicles directly connected with the accident. The best way to protect yourself and your family and minimize any impact upon you is to hire an experienced and knowledgeable firm with the know-how to resolve your case.

Tanker truck accidents are complex due to the number of potentially liable parties involved, the potentially hazardous materials that were carried by the tanker, and more. You need a lawyer with a specific skill set to manage all the details of your case and obtain compensation for you. We have that skill set.

Possible Compensation After a Tanker Truck Accident

You shouldn’t have to worry about the accident causing you financial headaches. When you were injured through no fault of your own, you may be able to obtain compensation for your damages. You could recover economic damages, which include things like medical bills and lost wages.

You might also be able to recover money for pain and suffering or loss of quality of life. An experienced tanker truck accident lawyer knows how to calculate the value of your claim and can help you pursue the compensation you deserve for your injuries.

What Regulations Do Tanker Trucks Have to Follow?

The Federal Motor Carrier Safety Administration (FMCSA) makes the regulations for tanker trucks and other commercial vehicles. In addition to having a valid commercial driver’s license, there are certain endorsements a driver must have to be qualified to drive a tanker truck. The driver must take and pass a knowledge test to receive this endorsement from the FMCSA.

According to the FMCSA code, in order to obtain a tank vehicle endorsement, each applicant must have knowledge of the following:

  • How to properly use emergency systems;
  • Variations in the construction of different types of tank vehicles;
  • How to brake properly when the tank is full, partially full, or empty;
  • Knowing what effects cargo surges have on the way a tanker truck handles, what causes them, and how to prevent them;
  • How to handle both non-baffled and baffled/compartments or tank interiors;
  • How a tanker truck is affected by the curvature or grade of a road when it is full, half-full, and empty;
  • How cargo surge is different for different densities of liquids;
  • Knowledge of the retest and marking rules for specific DOT tank vehicles; and
  • Other routine operating procedures and practices applicable to tanker trucks.

Commercial vehicle drivers are held to a higher standard than non-commercial vehicle drivers. Tanker truck drivers are held to yet a higher standard because of the potentially hazardous cargo they carry. Both the driver and trucking company have a duty to use extreme caution when operating a tanker truck on the roadway.

Top Cargo Tank Facility Regulations

Cargo tank facilities are inspected to verify that the appropriate rules and regulations are being followed.  The FMCSA requires these inspections and publishes their results, together with the section of the regulations that have been violated. These are some of the items for which these facilities are inspected:

  • Hazmat employees require retraining every three years
  • Pressure retest of equipment may be required upon request
  • Training records of employees must be kept for 90 days after termination
  • Leakage tests must be performed as required or requested by inspectors

There are strict requirements that commercial vehicles and the facilities from which they operate must abide by. Tanker trucks are more stringently regulated than other types of commercial vehicles

Hiring an attorney who is experienced in these regulations is crucial to a successful case outcome. Because we know the regulations, our firm is able to pinpoint any violations that could have been the cause of the tanker truck accident. The details of the case matter and knowing what to look for in the investigation will help us pinpoint who the actual at-fault parties were. Here at Jurewitz Law Group Injury & Accident Lawyers, we have the experience you need to win.
