$225‚000 Recovery
Our client was a San Diego office lighting company that was represented by another lawyer for a lawsuit against the company’s insurance company for failure to pay a claim against the company’s insurance policy. That prior lawyer obtained a partial settlement of $225‚000‚ which was deposited into his client-trust account. However‚ the lawyer then stole the money and used it for himself.
Although the lawyer had already repaid $75‚000 to our client‚ he failed to repay the rest. The lawyer then filed bankruptcy to try to avoid payment of the judgment. We hired bankruptcy co-counsel to help fight for our clients and were able to obtain a negotiated settlement in bankruptcy court for an additional $225‚000 to pay for the prior attorneys’ legal malpractice and fraud.
